This contract is an official and public offer by the Seller to enter into a sales contract for goods presented on the website https://young-blood.store/. This contract is public, meaning that according to Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers, regardless of their status (individual, legal entity, individual entrepreneur), without giving preference to one buyer over another. By entering into this Contract, the buyer fully accepts the terms and conditions for placing an order, paying for the goods, delivering the goods, returning goods, and any other contract terms. The contract is considered concluded once the buyer clicks the “Place Order” button on the order page in the “Cart” section and receives an order confirmation from the Seller via email.
1.1. Public Offer (hereinafter referred to as the “Offer”) – a public proposal by the Seller, addressed to an indefinite number of persons, to enter into a sales contract with the Seller for goods remotely (hereinafter referred to as the “Contract”) under the conditions specified in this Offer.
1.2. Product or Service – the subject of the transaction chosen by the buyer on the website of the online store and added to the cart or already purchased remotely by the buyer from the Seller.
1.3. Online Store – the Seller’s website at https://young-blood.store/ created for retail and wholesale sales agreements based on the buyer’s familiarity with the Seller’s offered product description via the internet.
1.4. Buyer – a legally capable individual over 18 years old who receives information from the Seller, places an order to purchase goods presented on the online store website for non-commercial purposes, or a legal entity or individual entrepreneur.
1.5. Seller – Private Entrepreneur Khomenko Anastasia Tarasivna (identification code 3571800048), according to the legislation of Ukraine, whose location is: Ukraine, Berezan, Tsegelna str, 9.
2.1. The Seller agrees to transfer ownership of the Product to the Buyer, and the Buyer agrees to pay for and accept the Product under the terms of this Contract.
2.2. The date of the Contract-offer (acceptance of the offer) and the moment of full and unconditional acceptance of the Contract terms by the Buyer is considered the date the Buyer completes the order form on the online store website, provided the Buyer receives electronic order confirmation from the Seller. At the Buyer’s request, the Contract can be prepared in written form if necessary.
3.1. The Buyer independently places an order in the online store through the “Cart” form or by ordering via email or the phone number listed in the Contact section of the online store.
3.2. The Seller reserves the right to refuse to process the order if the information provided by the Buyer during the order placement is incomplete or raises doubts about its validity.
3.3. When placing an order on the online store site, the Buyer agrees to provide the following mandatory information necessary for the Seller to fulfill the order:
3.4. The name, quantity, article number, and price of the goods selected by the Buyer are specified in the Buyer’s cart on the online store website.
3.5. If any of the Parties require additional information, they have the right to request it from the other Party. If the Buyer does not provide the necessary information, the Seller is not responsible for providing a quality service to the Buyer when purchasing goods from the online store.
3.6. By placing an order via the Seller’s operator (Clause 3.1 of this Offer), the Buyer agrees to provide the information specified in Clauses 3.3 – 3.4 of this Offer.
3.7. Acceptance of the terms of this Offer by the Buyer is made by entering the necessary data in the registration form on the online store website or when placing an Order through the operator. After placing an order through the Operator, the Buyer’s data is entered into the Seller’s database.
3.8. The Buyer is responsible for the accuracy of the information provided when placing the Order.
3.9. By entering into the Contract, i.e., accepting the terms of this Offer (proposed purchase terms), by placing an Order, the Buyer confirms the following:
4.1. Prices for goods and services are determined independently by the Seller and indicated on the online store website. All prices are listed in UAH, inclusive of VAT.
4.2. Prices for goods and services may be changed unilaterally by the Seller depending on market conditions. However, the price of a specific unit of Goods, fully paid for by the Buyer, cannot be changed unilaterally by the Seller.
4.3. The price of the Goods indicated on the online store website does not include delivery costs. The Buyer pays the delivery costs according to the current rates of the delivery service selected.
4.4. The price of the Goods listed on the online store website does not include the delivery cost to the Buyer’s address.
4.5. The Seller can indicate an estimated delivery cost to the Buyer’s address upon request by email or when placing an order through the online store operator.
4.6. The Buyer’s payment obligations are considered fulfilled when the Seller receives the funds.
4.7. Payments between the Seller and Buyer are made by the methods specified on the online store site in the “Payment and Delivery” section.
4.8. When receiving the goods, the Buyer must, in the presence of the delivery service representative, verify the goods’ compliance with quality and quantity specifications (product name, quantity, completeness, expiration date).
4.9. The Buyer or their representative confirms receipt of the Goods without complaints regarding quantity, appearance, and completeness by signing the sales receipt/order or transport document for delivery.
4.10. Ownership and risk of accidental loss or damage to the Goods pass to the Buyer or their Representative upon receipt of the Goods at the delivery location when picked up from the Seller or upon transfer by the Seller to the delivery service chosen by the Buyer.
5.1. The Seller is obligated to:
5.1.1. Transfer the goods to the Buyer in accordance with the terms of this Contract and the Buyer’s order.
5.1.2. Not disclose any private information about the Buyer or grant access to this information to third parties, except as required by law or for fulfilling the Buyer’s order.
5.2. The Seller has the right to:
5.2.1. Unilaterally modify the terms of this Contract and prices for goods and services by posting updates on the online store website. All changes take effect upon publication.
5.3. The Buyer is obligated to:
5.3.1. Before concluding the Contract, review the content, terms of the Contract, and the prices offered by the Seller on the online store website.
5.3.2. For the Seller to fulfill its obligations to the Buyer, the Buyer must provide all necessary information to clearly identify them as the Buyer and to facilitate the delivery of the ordered goods.
6.1. The Buyer has the right to return non-food goods of satisfactory quality to the Seller if the goods did not meet their expectations in terms of shape, size, design, color, or other characteristics and cannot be used for their intended purpose. The Buyer may return goods of satisfactory quality within 14 (fourteen) days, excluding the purchase date. Returns are accepted if the goods were not used and retain their original appearance, consumer properties, packaging, seals, labels, and the receipt issued to the Buyer for payment of the goods. The list of goods not eligible for return based on the conditions outlined in this clause is approved by the Cabinet of Ministers of Ukraine.
6.2. Refunds for goods of satisfactory quality are processed within 30 (thirty) calendar days from the date the Seller receives such goods, provided that the requirements specified in Clause 6.1 of the Contract and the applicable Ukrainian legislation are met.
6.3. The value of the returned goods is refunded to the Buyer via bank transfer to the Buyer’s account.
6.4. The return of goods of satisfactory quality to the Seller’s address is done at the Buyer’s expense and is not reimbursed by the Seller.
6.5. If defects are discovered within the warranty period, the Buyer has the right to present claims to the Seller personally, in the manner and within the timeframes established by Ukrainian law. For claims regarding free repair of defects, the time frame for repairs begins from the date the Seller receives the goods and gains physical access to them.
6.6. The Seller considers claims under the Law of Ukraine “On Consumer Protection” provided the Buyer submits the documents required by Ukrainian law. The Seller is not responsible for defects in the goods that occurred after the goods were handed over to the Buyer due to improper handling, storage, actions of third parties, or force majeure.
6.7. The Buyer does not have the right to refuse goods of satisfactory quality that have custom characteristics if the goods can only be used by the Buyer who purchased them (including non-standard sizes, specifications, appearance, and assembly as requested by the Buyer). Confirmation that the goods have custom characteristics includes differences in the product size and other specifications listed on the online store.
6.8. The return of goods, as stipulated by law and this Contract, is carried out at the address listed on the website in the “Contacts” section.
7.1. The Seller is not liable for any harm caused to the Buyer or third parties resulting from improper installation, use, or storage of goods purchased from the Seller.
7.2. The Seller is not liable for improper or delayed fulfillment of orders and obligations if the Buyer provided false or incorrect information.
7.3. The Seller and Buyer are liable for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Contract.
7.4. The Seller or Buyer is released from liability for full or partial failure to fulfill their obligations if the failure is due to force majeure circumstances, including war or hostilities, earthquakes, floods, fires, and other natural disasters beyond the control of the Seller and/or Buyer after the conclusion of this contract. The Party unable to fulfill its obligations must immediately notify the other Party.
8.1. By providing personal data on the online store website during registration or placing an Order, the Buyer voluntarily consents to the processing, use (including transfer), and handling of their personal data as specified by the Law of Ukraine “On Personal Data Protection,” without any time limitations on such consent.
8.2. The Seller agrees not to disclose information received from the Buyer. It is not considered a breach for the Seller to provide information to contractors and third parties acting on the Seller’s behalf, including for fulfilling obligations to the Buyer or where disclosure is required by the current legislation of Ukraine.
8.3. The Buyer is responsible for keeping their personal data up-to-date. The Seller is not responsible for the poor performance or non-performance of obligations due to outdated or inaccurate Buyer information.
9.1. This contract is concluded on the territory of Ukraine and is governed by the current laws of Ukraine.
9.2. All disputes arising between the Buyer and the Seller will be resolved through negotiations. If negotiations fail to resolve the issue, the Buyer and/or Seller may seek dispute resolution in court per the applicable laws of Ukraine.
9.3. The Seller has the right to amend this Contract unilaterally as stipulated in Clause 5.2.1 of the Contract. Additionally, changes to the Contract may also be made by mutual agreement of the Parties in accordance with the current laws of Ukraine.
